We will be voting on the following resolution that was adopted by the Board of Directors:

RESOLUTION:

WHEREAS The Maryland State Highway Administration (SHA), a division of the Maryland Department of Transportation (MDOT) installed temporary bike lanes along University Boulevard between Arcola Avenue and Amherst Avenue without sufficient or timely outreach to affected communities, including Kemp Mill.

and WHEREAS The study included changes to the intersection of Arcola Avenue and University Boulevard that had a significant effect on Kemp Mill residents

and WHEREAS When the SHA did meet with the community the plans for the pilot were already finalized, leading to anger among members of the community that the SHA was not taking the community’s concerns into account

and WHEREAS The SHA made assurances that the changes related to the study were temporary, that the study results would be released to the public, and that there would be further opportunities for public input before any permanent changes would be made, but the Secretary of the MDOT later made public statements that the lanes would be left in place after the conclusion of the study, leading to further anger in the community.

THEREFORE BE IT RESOLVED BY THE KEMP MILL CIVIC ASSOCIATION, that no permanent changes to University Boulevard involving the removal of lanes or reconfiguration of the intersection at Arcola Avenue should be made until:

The SHA releases the results of the bike lane study to the public and

The SHA allows significant opportunities for affected communities to provide input on any proposed changes. Such public input should be sought early enough in the process that it can be taken into account before any plans are finalized

Reminder: There will be a KMCA general meeting tonight, Monday June 21st at 7:30 PM under the tent outside the Chabad at Lamberton and Lovejoy. The original meeting notice and agenda are below.

Due to a last-minute emergency our Transportation Committee chair will not be able to attend the meeting. We will still have a brief discussion about the University Boulevard Shared Streets project and members are encouraged to contact him directly (gchlewicki@gmail.com) with any questions or concerns.

We will have some pizza available for attendees which was generously donated by Ben Yehuda Pizza. It’s probably still going to be hot outside after 7 PM  so please bring something to drink.

Due to the limited space available, the meeting is limited to KMCA members. That includes new members who join at the meeting. If you’re not currently a member and you live in the KMCA’s area you are welcome to join the Association and attend the meeting.

We will be starting the meeting at 7:30 PM. If you plan to join or renew your membership at the meeting please arrive at least 15 minutes early. If there are severe weather warnings in effect this evening, please check the KMCA website’s main page for updates before heading to the meeting. As long as there are no ‘take shelter inside’ warnings in effect for our area we will hold the meeting as scheduled.

She served on the Montgomery County Planning Board for eight years, and has been deeply involved with county land use issues for over 20 years. She ran unsuccessfully for County Council in District 1 in 2018.

KMCA General Meeting – Monday December 28, 2020

KMCA Members,

The final KMCA general meeting of 2020 will be held via Zoom on Monday December 28, 2020 at 7:30 PM. We will have two speakers from Montgomery Parks, one discussing the Wheaton Regional Park Master Plan and one covering options for changes to the 2 to 5 year old children’s play area at Kemp Mill Urban Park. They are asking for the KMCA’s input on which options they should select for the playground. If you are planning to attend the meeting please review the four options prior to the meeting. They’ve been posted to our web site at https://www.kempmillcivic.org/?p=1310.

I’ve set time on the agenda for a speaker from Maryland MVA to answer any questions the community may have about the MVA office that will be opening soon in the Kemp Mill Shopping Center. I have not been able to confirm the attendance of the MVA representative so for now that agenda item is tentative. If no one from MVA is able to participate in the meeting we’ll move the rest of the agenda forward by 15 minutes.

We will also be voting on the proposed KMCA budget for 2021. The draft prepared by our Treasurer and approved by the Board of Directors is below.

KMCA General Meeting – Tuesday September 22, 2020 @ 8 PM

The KMCA will be holding a general meeting on Tuesday September 22nd, 2020 at 8:00 PM at the Chabad located at the corner of Lamberton Drive and Lovejoy Street. We will be meeting outdoors under their tent so please dress for the weather. All attendees must wear a mask or face covering.

This will be an abbreviated meeting with only a limited agenda.

8:00 – Call to order.
8:05 – Adoption of agenda, approval of minutes of previous meeting, membership and treasurer’s report.
8:10 – Election
8:20 – Vote on bylaws amendments 
8:30 – Adjourn

We will be holding an election for Vice President, Treasurer, and three directors whose terms expired this year. The election should have been held at the second quarter meeting, but the Board of Directors voted to delay that meeting due to the pandemic. Since the nominating committee had found a single candidate for each of the positions the Board voted to temporarily elect the nominees for each position. That temporary election needs to be ratified by the membership at this meeting. We will also be soliciting nominations for a director position that is vacant as the result of a resignation from the Board, with a term expiring in 2021. Nominations can be made from the floor for any of these positions. Candidates must be nominated by two members and must agree to serve if elected. 

The only other agenda item for the meeting will be to vote on amendments to the KMCA bylaws. The current bylaws do not allow for virtual general meetings and would require us to make up the 2nd quarter meeting that was skipped by having two meetings in the 3rd quarter. The amendments (see below) would allow the Board, by a 2/3 vote, to cancel a meeting rather than postpone it and would allow for virtual meetings. These amendments were suggested by the existing Board members to allow the Association to function as best as is possible while under the pandemic-related restrictions and leave us better prepared for future emergencies.

BYLAWS AMENDMENT PROPOSAL:

Amend Article 5, Section 1.1 and add Sections 1.2 through 1.4 to add the text noted in bold
below:

ARTICLE 5 – SECTION 1.1 – In the event of unforeseen situations such as inclement weather and/or a public emergency, a regularly scheduled meeting may either be postponed to the subsequent quarter or canceled. A meeting can only be canceled with a 2/3 vote of the Board of Directors, which means there would not be two meetings in the following quarter. Meetings cannot be cancelled in two consecutive quarters. 
SECTION 1.2 – Should a scheduled election need to be postponed to the following quarter, the current officers up for election shall extend their term until an election can be held. 
SECTION 1.3 – In the event that no meeting is held in a quarter, The Board of Directors shall be responsible for the business of the Association from the end of that quarter until the next meeting can be held. All non-administrative votes held by the Board of Directors during this period will require 2/3 approval for passage. At the next meeting, the Board of Directors are required to discuss all votes held during this period. Members at the meeting may vote to rescind any Board of Directors vote by a simple majority.
SECTION 1.4 – In the event of a prolonged public emergency where a meeting cannot be held in person in consecutive quarters, a virtual meeting can be held. Proper communication to notify Members of the upcoming meeting shall remain the same as stated in Article 2. All regular business may be held in a virtual meeting except for elections and Amendments to the Bylaws. 

Amend Article 3, Section 1.1 to add the text noted in bold below:
Article 3, SECTION 1.1​ –A Member must be physically present at the meeting to vote.
During a virtual meeting held under Article 5, Section 1.4 a member must
participate in the virtual meeting to vote. No proxy or absentee votes are
allowed.

County Public Hearing on Kemp Mill Sidewalk Plan Postponed

Montgomery County has decided to postpone the public hearing on the Kemp Mill sidewalk plan from March 25th to April 22nd at 7 PM. The hearing will now be a virtual public hearing which will be conducted online via Adobe Connect.

Residents who wish to testify can do so during the online hearing or by submitting written comments. Written testimony is given the same weight by the hearing examiner as verbal testimony.

Affected residents should be receiving a copy of the below letter via the mail within a few days.

Next KMCA Meeting – Wednesday March 11th, 2020

The next KMCA general meeting will be held on Wednesday March 11th, 2020 at 7:30 PM. The meeting will be in the all-purpose room at Kemp Mill Elementary School, 411 Sisson Street. Please try to arrive a few minutes early to check in so we can start on time. I will post a detailed agenda prior to the meeting.

We will have the Community Services Officer from the Montgomery County Police 4th District speaking at the meeting about recent crime trends and crime prevention tips.

We will also have a representative from the Montgomery County Department of Transportation who will be speaking about the County’s new Vision Zero program to eliminate traffic fatalities as well as other DOT projects in our area. The project to add sidewalks to several streets in Kemp Mill will be the subject of an upcoming public hearing. The County will be notifying affected and adjacent homeowners of the date by mail and I will also send out a notice to the KMCA membership once the date is finalized.

Non-members are welcome to attend the meeting but only KMCA members may vote on any Association business. If you live in the KMCA’s area and are not a member or you are already a member and need to renew please do so here. You can also join or renew at the meeting. Dues are still only $10 a year.
